MARYLAND TRUCK ACCIDENT LAWYER

ANDREW M. RODABAUGH

Tractor Trailor Accident Attorney

A truck accident lawyer ready to fight for you!

Mr. Rodabaugh zealously represents his clients with the intention of getting them all of the benefits to which they are owed.  For victims involved in trucking accidents this can be particularly important because of the devastating affects tractor trailers can cause when a collision occurs.  Everyday there are minor fender benders that require zero to little treatment, however when an 18 wheeler is involved in an accident there is rarely little damage or injury.

While there certainly are similarities between a typical auto collision and a tractor trailer collision there are a number if differences that the public should know about so that they are better informed, but also so that the knowledge can assist them if they are making decisions regarding an accident without a tractor trailer attorney on their side.  Some of the differences include limits in insurance coverage tractor trailers must carry, unique liabilities to which tractor trailer owners/drivers are exposed, obtaining compensation for the negligent truck driver in some cases (workers compensation), licensing requirements, types of accidents.  A truck accident attorney with the right intentions, legal aggressiveness, and motivation will be an absolute necessity in many trucking cases.

Licensing requirements for truck drivers

There are a number of different licenses available through the Maryland Vehicle Administration each with varying requirements.  Most people are aware of the requirements to obtain a license to operate the ordinary every day car or truck.  Truck drivers are required to obtain additional licenses to operate a commercial vehicle.

A Commercial Drivers Licence (CDL) are offered to qualifying candidates only after a number of tests and qualifications are met.  Some CDL contain restrictions based on the type of testing the candidate performed and passed.  For instance one who did not qualify by testing in a tractor trailer will have an “O” restriction.  There are a number of other restrictions that can be placed on any CDL including those licenses that restrict driving a truck which has air brakes, driving trucks that weigh over 10,000 lbs, automatic versus manual trucks, and those who are qualified to drive a truck with air over hydrolic brakes.

For more information on CDL the MVA page can be helpful.

Insurance Coverage and truck accidents

In Maryland those who drive a car are required by law to have atleast $30,000 in insurance coverage.  For many auto accidents this amount of coverage is sufficient for the medical treatment and some pain and suffering settlement, however when dealing with truck accidents this is often a drop in the bucket and not enough to cover medical treatment let alone pain and suffering and property damage.  Under federal regulations truck insurance coverage must be a minimum of $300,000 under Federal law however this only applies to Commercial trucks carrying non hazardous material that weigh under 10,001 lbs.  This would include some box trucks and exclude tractor trailers.  The Federal Motor Carrier Safety Administration has higher insurance minimums set for those commercial drivers including $750,000 for tractor trailers but going up to $5,000,000 limits depending on the freight carried and if passengers are carried such is the case with touring buses.

Attorney’s dealing with tractor trailor accidents will not only be well informed about insurance coverage, but they will be able to assist in recovering maximum compensation!

Types of accidents leading to the need for a truck accident lawyer

There is good reason to have licensing requirements for truck drivers- when they are involved in a collision the amount of damage is usually much greater than the damage involved in a one on one car accident.  The weight and size of tractor trailers can often cause catastrophic and fatal injuries for both the truck driver and others cars involved.  Because of the increased risk of extensive damage the state requires truck drivers to obtain the extra knowledge, skills, and abilities so that they are better qualified to avoid accidents and understand the potential for damage.  There are a number scenarios which lead to the need for a qualified and experienced truck accident lawyer.

Lane change and blind spot collision with tractor trailer– When traveling down one of Maryland’s highways it is not unusual to see a tractor trailer starting to maneuver from one lane to the next absolutely unaware that there is a car in its path.  Simply changing lanes on a highway is a dangerous maneuver, but when a reckless truck driver performs this task the risk of accident is greatly elevated.  Rates of speed are usually higher on highways compared to rates of speed on the secondary roads which ordinary makes accidents on highways involving tractor trailers of greater significance than those on secondary streets.

Wide Turn Collisions– On most tractor trailers there is a warning label on the back of the tractor trailer which indicates that it makes wide turns.  This label is there so that other drivers are aware that sometimes it is impossible for the tractor trailer driver to maneuver a turn without entering the lanes adjacent to the one the truck is in.  Occasionally the wide turn of the truck will lead to a collision with another driver in their lane.  Liability in these cases sometimes falls on the truck driver, while other times the liability falls on the driver of the car.

Tractor trailer red light collisions– Red light accidents can cause some of the most severe injuries of any form of accident because they often involved one car traveling at full speed.  Often these truck accidents occur when a driver is completely neglectful of the traffic signals ahead and do not have adequate time to slow to a stop.  Again, because of the weight and size of tractor trailers and big trucks the time to come to a complete stop is much longer than the ordinary commuter car.  Truck drivers are aware of this fact and failure to come to a complete stop at a red light or stop sign is negligent in itself.  When a truck is involved in a red light accident the damage can be quite unbelievable and even fatal.

Truck collisions on highways– Accidents on our highways are inevitable given the amount of commuters and the inherent risks associated with car travel but add the often high rates of speed and congestion on the highways and they are prime location for accidents.  While trucks are a smaller portion of overall traffic on highways they are certainly more dangerous and pose a heightened risk of high damage collisions.  Truck accident lawyers should almost always be consulted when one is involved in a crash.

18 wheelers in the city– There is usually a distinguishing factor between highway truck accidents and city truck accidents and that is the velocity at which the accident occurs.  City collisions tend to occur at a lower rate of speed and often result in far less damage to the victim while highway truck accidents often bring devastating and life altering injuries.  It is however necessary to have tractor trailers enter city limits in order to deliver much needed freight for the residents which means there will be occasional incidents.  It is not the speed of tractor trailers that are ordinarily the cause of truck accidents in the city, but navigational issues that more often lead to collisions.

Truck accident attorney Andrew M. Rodabaugh can help recover compensation in many types of truck accidents

More often than not when a person thinks about a tractor trailer case they immediately think of the scenario when an ordinary commuter is traveling in their car and they are the victim of the crash which is caused by a truck.  While this is probably the more common truck crash case there are other scenarios which may entitle a person to compensation when involved in an accident.

  • Truck accident attorney Mr. Rodabaugh may be able to recover workers compensation benefits for the injured!  This is especially likely in the event the truck driver injures himself in the state of Maryland.  Regardless of negligence truck drivers who are involved in an accident more than likely are entitled to workers compensation benefits.  In the event they were not negligent but injured by the negligence of another they would also be able to seek out compensation through a negligence lawsuit.
  • Unfortunately, as I previously discussed, because of the size and weight of tractor trailers when they are involved in a collision fatal injuries sometimes occur.  Family members and dependents of the fatally injured driver are stricken with grief that may last years if not a lifetime.  In addition with dealing with the loss they are forced to cope with financial burdens that would otherwise not be present.  Maryland law provides these individuals the right file suit for loss of consortium through a wrongful death suit.  In some instances the family can also recover money on behalf of their lost family member which would in turn go to the estate.
  • Many jobs require the employee to travel the roads of Maryland on a daily basis.  In most circumstances if an employee is required to travel as part of their occupation and that person is involved in a tractor trailer collision they would be entitled to workers compensation benefits as well as a potential personal injury lawsuit.  For these cases it is important the victim retain a truck accident lawyer as well as a Maryland workers compensation attorney.
