The truth is that workers compensation lawyers can only charge a person if that person becomes a client and money is recovered on behalf of that person.  Maryland law requires workers compensation attorneys be paid according to the statutory code which lists the percentages and fees allowed.  A consultation with a Maryland workers compensation attorney may vary greatly depending on the attorney but  consultations are always free no matter who the workers compensation lawyer is or if they are retained to represent the injured workers.

How long will the free consultation with a  Baltimore workers comp lawyer last?

In my experience the ordinary free consultation lasts approximately 10 to 15 minutes.  This provides enough time for the workers comp lawyer to give an outline of the workers compensation process as well as answer any questions the injured Maryland worker may have at that time.  The time of the consultation can vary depending on the availability of the attorney but also the amount of questions the injured employee may have.  While free consultations with workers comp lawyers can take place over the phone, it is best to obtain a phone consult and then schedule an in person appointment to go into further details about the case.  After the phone consult the injured worker is likely to have more questions.  It is good practice for the injured worker to write down questions that arise after the phone appointment and then schedule to meet the lawyer for further discussion.  Most workers comp lawyers are willing to have at least one or two conversations before they may indicate that further discussions require representation.

During the free consultation will I be pressured by the Baltimore Workers Comp lawyer to hire him or her?

Unfortunately there are some attorneys that feel the need to pressure injured workers into hiring them.  These workers comp lawyers are largely the exception and the not the ordinary.  A no pressure consultation will help build a healthy relationship among the person and the attorney, and will also encourage trust.  The injured Maryland worker is already under enough pressure and stress and ordinarily does not respond well to pressure from someone that is suppose to be there to help.  Most of the time the free consultation provided by the workers comp lawyer is however limited in scope and duration to a reasonable amount of time.

If the consultation lasts a long time will I receive a bill from the Baltimore Maryland workers comp lawyer?

Under Maryland law a workers compensation attorney that is consulting an injured worker can not charge for the consult. While defense attorneys are not controlled by this rule, a Claimant’s lawyer consulting an injured worker may not charge for a consult.  Under Maryland law an attorney representing an injured worker is paid on a contingency basis which means they get paid when they recover money for the injured worker.  These regulations can be found in the Code of Maryland Regulations at

What will be discussed during my free consultation with the Baltimore Workers Comp lawyer?

Consults vary greatly depending on the injured worker and the lawyer consulted.  Some of those injured at work in Maryland will have only a couple of questions that they need answered, while others may just want some guidance as to what is going on in their case or explanation as to their rights.

The style of consult will vary from one attorney to the next.  It is often a good idea for the injured worker to come with a list of questions to ask during the free consultation with the workers comp lawyer.  Another step is to do a bit of research prior to the appointment so that the conversation can be more meaningful.

Some of the most common questions asked during a consult include:

What is the Maryland Workers Compensation Process?

How much does the attorney get paid?

What is the value of my case?

Can I be fired for filing a claim?

If you are really unsure if you want to hire an attorney see the pros and cons.

How to get the most value out of the free consultation with a Baltimore workers comp lawyer:

  • Prioritize the questions you really need answered.  At a certain point the lawyer will be out of free time to discuss your case and the conversation will come to an end.  The saying that time is money applies in this case.  Early in the free consultation with the workers comp lawyer ask the questions that matter the most.
  • It is ok to call and discuss your case with multiple attorneys.  When obtaining a free consultation with a workers comp lawyer make sure to take note of the answers so the same questions are not asked of the next attorney called.
  • Attorney’s offer free consultations in hopes that the discussion can turn in to a representation.  If you contact the same attorney for a free consult and they indicate that they want to represent you it is usually in your best financial and legal interest.
  • In most cases the free consultation with a workers comp lawyer can take place at their office or some other location, but face to face.  It is often more comfortable for both parties to meet face to face when discussing personal issues, more importantly a face to face meeting can help the attorney answer questions more effectively.
